Hereinafter referred to as "Dalte", "we", "us" or "service provider".

2. Purpose

These Terms and Conditions govern the access and use of the website dalte.pt, as well as the contracting of wedding photography and videography services provided by Dalte.

Use of the website and/or contracting of services implies full and unreserved acceptance of these Terms and Conditions.

3. Services Provided

Dalte provides the following services:

  • Wedding photography

  • Wedding videography

  • Engagement sessions

  • Pre-wedding sessions

  • Complementary services (albums, same-day edits, etc.)

The specific services, deadlines, prices and particular conditions of each project are defined in an individual contract entered into between Dalte and the client.

4. Booking and Contracting

4.1. Quote

The quote is prepared based on the information provided by the client (date, location, duration, number of professionals, additional services). The quote is valid for 30 days, unless otherwise stated.

4.2. Date Reservation

The date is only considered reserved after:

  • Express acceptance of the quote by the client

  • Payment of a booking deposit of 10% of the total

  • Signature of the service agreement

4.3. Payment

  • Deposit: 10% at the time of booking

  • Remaining balance: 70% up to 2 days after the wedding date (or as agreed) and 20% when final edits are delivered

  • Accepted payment methods: bank transfer, [others]

5. Cancellation Policy

5.1. Cancellation by the Client

  • Cancellation has no refund of the 10%

5.2. Cancellation by Dalte

In the event of cancellation attributable to Dalte, the client is entitled to a full refund of amounts paid, without prejudice to any compensation under the law.

5.3. Force Majeure

Force majeure events (natural disasters, pandemics, government restrictions, etc.) will be analysed on a case-by-case basis, and the date may be rescheduled without penalty.

6. Intellectual Property and Copyright

6.1. Dalte's Rights

All content created by Dalte (photographs, videos, edits, graphic materials) is protected by copyright, under the Portuguese Copyright and Related Rights Code (CDADC).

6.2. License Granted to the Client

Dalte grants the client a personal, non-commercial license to use the delivered content for private purposes (sharing with family and friends, personal social media, printing for personal use).

6.3. Prohibited Uses

Without Dalte's written authorisation, the client may not:

  • Sell, license or transfer the content to third parties

  • Use the content for commercial or advertising purposes

  • Substantially alter, edit or modify the content

  • Remove watermarks or metadata

6.4. Portfolio Rights

Dalte reserves the right to use the produced content for portfolio promotion (website, social media, promotional materials, award submissions), unless the client submits a written objection before the event date.

7. Personal Data Protection (GDPR)

7.1. Data Controller

Dalte is the controller of personal data collected within the scope of its activity, under Regulation (EU) 2016/679 (GDPR) and Portuguese Law No. 58/2019.

7.2. Purposes of Processing

Personal data is processed for:

  • Contact and quote management

  • Performance of the service agreement

  • Communication with the client

  • Compliance with legal obligations (tax, accounting)

  • Portfolio promotion (with consent)

7.3. Data Subject Rights

The client may exercise, at any time, the rights to:

  • Access, rectification and erasure

  • Restriction and objection to processing

  • Data portability

  • Withdraw consent

7.4. Data Retention

Data is retained for the period necessary to fulfil the purposes and comply with legal obligations (minimum of 10 years for tax purposes).

7.5. Complaints

The client has the right to lodge a complaint with the Portuguese Data Protection Authority (CNPD)www.cnpd.pt.

8. Liability

8.1. Limitation

Dalte is not responsible for:

  • Technical failures beyond its control (internet, third-party equipment)

  • Loss or damage caused by unforeseen circumstances

  • Delays resulting from weather conditions or event logistics

8.2. Backups

Dalte undertakes to keep backup copies of the content for 24 months after delivery. After this period, it does not guarantee the availability of the original files.

9. Warranties and Complaints

The client must verify the delivered content within 15 days of receipt. Complaints must be communicated in writing to mail@dalte.pt, describing the issue in detail.

Dalte undertakes to correct errors or faults attributable to its work within a reasonable timeframe.

10. Changes to the Terms

Dalte reserves the right to change these Terms and Conditions at any time. Changes take effect upon publication on the website and apply only to future contracts.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law.

For dispute resolution, the parties elect the Court of the District of Cascais, with express waiver of any other.

In the event of a consumer dispute, the client may resort to Alternative Dispute Resolution (RAL) entities — list available at www.consumidor.gov.pt.
